in the beginning of december i asked for a check withdrawal to india which never got to me and in spite of asking paypal to stop the payment of the check and refund the money back to my account there is been nothing but stony silence from them. they do not reply to my help requests and there is no sign that my check has been stopped and payment refunded.
can you tell me what i should do now and how to take legal action against them?

First of all, check your local post office. You may find your cheque there.

If it failed, try to call them on their phone numbers and talk politely. This may solve your issue.

If not, talk with your lawyer. He can guide you better than us.

Have you read their Withdrawing Funds Help?

As per their help, they cannot cancel withdrawal. Read the help to know more.

one can stop payment on a check sent by them in response to a withdrawal request. i have checked with the post office but they dont have a clue. since i am living in india i wanted to know how best to proceed next. nobody seems to pick up the phone either

I dont know, but i saw few sites which the main purpose is to blame PayPal with many complains like yours.
For the other side it cant be massive phenomenon ...
The first thing to do is stop accepting money to PayPal in your case

paypal is terrible we don't deal with them anymore and recommend the same for everyone else...

I guess all companies have their share of "issues".

I have dealt with paypal for over 10 yrs and never have had any problems.

I have needed to call them 2 times and both times spoke with a very knowledge based person and had my problem corrected.

If you use Paypal for what they're good at - online account-to-account payments, you'll not go wrong. They have millions of transactions a month, so the single-figure complaints suggests its a good service.

I've used them since before they were part of ebay, and only had one problem - they suspended my account due to 'suspected illegitimate access'. It was frustrating, it took several days to sort out. But I'd rather that than have someone raid my funds!

But zero problem on payments, receipts or charges.
